An illegal alien has been arrested for the alleged murder of his ex-girlfriend in Utah – just days after he was deported from the U.S., authorities say.
On Christmas Eve, 24-year-old Nestor Rocha-Aguayo was removed from the U.S. by Immigration and Customs Enforcement and ordered to not return, according to a police affidavit reviewed by KSL.
Less than six days later, Rocha-Aguayo apparently reentered the country and made contact with his longtime lover, 31-year-old Talia Benward.
Benward, a resident of Salt Lake County, borrowed a family member’s car on Jan. 1 and then disappeared.
Two days later, Benward’s family alerted the Unified Police Department that she had not returned with the vehicle nor shown up to work.

Detectives served a search warrant for Benward’s electronic devices and found “conversations with Nestor (Rocha-Aguayo) asking Talia (Benward) to come and pick him up at the Maverik in West Jordan on Jan. 1,” the affidavit states.
Surveillance footage reviewed by investigators reportedly showed Rocha-Aguayo getting into the loaned vehicle with Benward on the afternoon of Jan. 1.
After a brief normal interaction, “the video showed their movements eventually became sharp, they began pointing at each other, they rolled up their windows and it appeared as if they were arguing,” according to the affidavit.
Investigators tracked cell phone data and determined devices belonging to Rocha-Aguayo and Benward traveled into nearby Tooele County, but eventually only Rocha-Aguayo’s mobile returned to Salt Lake County while Benward’s stopped moving in an area near I-80.
The trail of Rocha-Aguayo’s device led police to the town of Kearns, where they located the missing vehicle.
“Detectives observed what appeared and was later confirmed by forensics to be human blood on the outside of the back passenger door,” the affidavit explains.
“A warrant was obtained to search the vehicle and more blood was located in the back rear passenger seat, on the back passenger door and on the floor. Detectives also noticed the floor mat was missing on the back passenger floor, but the other mats in the car were not missing. It was also noted inside the trunk of the car, it smelled heavily of gasoline.”
On Saturday morning, authorities found Benward’s body in a pile of “strategically stacked” branches and sticks near a burn pit in a remote area.
Her face and neck reportedly showed shows of “substantial trauma.”
Officers located Rocha-Aguayo in West Valley City later that day and pulled over the vehicle he was in.
However, Rocha-Aguayo managed to escape, despite officers using a taser in an attempt to neutralize him.
Local authorities and the U.S. Marshals Service continued the hunt for Rocha-Aguayo and reportedly learned he was “onboard an international travel bus headed to Mexico.”
The suspect was located on the bus during a stop on Sunday in Fillmore, UT.
“Marshals attempted to take Nestor (Rocha-Aguayo) into custody again and he tried to flee a second time and was forcefully taken into custody. Nestor (Rocha-Aguayo), while in custody, attempted to jump from a moving vehicle while being transported,” the affidavit states.
Rocha-Aguayo was hit with a slew of charges, including aggravated murder, aggravated robbery, evidence tampering, abuse or desecration of a dead body, escape, burglary of a dwelling, possession of a stolen vehicle, and failing to stop for police.

Rocha-Aguayo reportedly had a long history of violent incidents with Benward and had even been convicted in multiple cases involving her.
His country of origin remains unclear at this time.
