The Trump administration challenged the Temporary Restraining Order that halted deportations under the Alien Enemies Act.
Judge Patricia Millett agreed with Deputy Assistant Attorney Drew Ensign that the wartime law is constitutional but questioned how it was implemented — asking whether, in the absence of due process, she might be labeled a gang member and deported without a hearing.
Judge Boasberg denied the administration’s bid to lift his hold and found that Venezuelan nationals the administration wants to deport should most likely be given the opportunity to challenge the allegations.
