Legal Battle Over Foreign Terrorists Sent to El Salvador Supermax Rages On – Border Hawk White House Dispatch

The legal battle between the Trump administration and Judge James Boasberg continues following flights of alleged Tren de Aragua terrorists to El Salvador’s massive prison CECOT.

The United States Court of Appeals for the D.C. Circuit heard arguments from the government and the ACLU on Monday, but the appeals court didn’t immediately rule.

The Trump administration challenged the Temporary Restraining Order that halted deportations under the Alien Enemies Act.

Judge Patricia Millett agreed with Deputy Assistant Attorney Drew Ensign that the wartime law is constitutional but questioned how it was implemented — asking whether, in the absence of due process, she might be labeled a gang member and deported without a hearing.

Judge Boasberg denied the administration’s bid to lift his hold and found that Venezuelan nationals the administration wants to deport should most likely be given the opportunity to challenge the allegations.
